    Initiating divorce in Houston: Things worth knowing

    The process

    The time required

    Like other states, there is a cooling-off period in Texas too. Even when you and your spouse agree to finalize the divorce, the process will take at least 60 days, which is the minimum period you have to wait to get divorced in Texas. 

    Division of property and assets

    Texas is a community property state. This means that most assets and debts acquired during the marriage would be considered community property and must be divided equitably. Equitable distribution does not always mean equal. In some cases, the court may consider factors like earning abilities of both spouses, if there was marital misconduct and other aspects.
